These Terms & Conditions (“Terms”) apply to purchases of products from Homa India (OPC) Private Limited (“Homa Atelier”, “we”, “us” or “our”) through our website, social-media channels, order forms, direct messages, telephone or WhatsApp orders, or any other sales channel. By placing an order, the customer (“Customer”, “you” or “your”) agrees to these Terms.

At Homa Atelier, we work with handmade, natural, artisan-crafted, vintage, reclaimed and repurposed materials. Many pieces are made by hand and carry the subtle marks and variations that make them unique. This policy explains what you can expect when you order from us, from payment and delivery to returns, damages and care.

Many Homa Atelier pieces are handmade or crafted from natural materials such as terracotta, wood, silk, jute, bamboo and water hyacinth. Others are vintage, reclaimed, upcycled or repurposed.

For this reason, no two pieces are exactly alike. Variations in colour, texture, grain, weave, shape, glaze, firing marks, patina, knots or dimensions may occur. Small irregularities are often part of the character of the piece rather than a defect.

Our photographs aim to represent products accurately, but colours can look slightly different depending on lighting, photography and your screen.

An order becomes confirmed once Homa Atelier has accepted it and, where applicable, received the required payment or advance. Some pieces are one-of-a-kind or available in limited quantities, so availability is subject to confirmation.

Before ordering, please check the product description, dimensions, photographs, material information and care instructions. If you are unsure whether a piece will work for your space, please contact us before placing the order.

Placing an order or submitting an order request does not, by itself, constitute acceptance of the order by Homa Atelier. Similarly, an order acknowledgement, payment receipt, automated message or communication stating that an order has been “received”, “placed”, “submitted” or is “being processed” does not, by itself, constitute confirmation or acceptance of the order.

All orders are subject to product availability, verification of the order details and receipt of the applicable payment or advance, where required.

An order will be deemed “Confirmed” only when Homa Atelier has reviewed and accepted the order and has sent the Customer an Order Confirmation by email, WhatsApp or other written communication expressly confirming the order.

Prices are stated in Indian Rupees unless otherwise mentioned. Applicable taxes, delivery charges and special handling or installation charges will be communicated before or at the time of purchase.

Payment must be completed through the payment method provided by Homa Atelier. Selected custom, made-to-order or specially sourced pieces may require an advance or full payment before work or procurement begins.

If a product has been listed at an obvious pricing error, Homa Atelier reserves the right to cancel the affected order and refund any payment already received.

Some pieces may be made, altered, personalised or specially sourced for you. We will communicate the expected lead time before confirming such an order. Because these pieces are created specifically for you, cancellations, changes and returns may not be possible once production, alteration or sourcing has begun, except where required by applicable law or where Homa Atelier agrees otherwise.

We take care to pack your pieces appropriately, particularly fragile items such as terracotta, ceramics, glass and lamps.

Delivery timelines are estimates rather than guaranteed dates. Actual delivery can be affected by courier schedules, weather, holidays, strikes, remote-area delivery, transportation disruption and other circumstances beyond our reasonable control.

Delivery charges will be communicated at the time of purchase unless shipping is expressly included in the product price.

Please make sure your delivery address and contact number are accurate. Changes after dispatch may not always be possible and may result in additional charges.

Please inspect the parcel as soon as it arrives. For fragile or valuable pieces, we strongly recommend making a continuous unboxing video showing the unopened parcel, shipping label, outer packaging, inner packaging and product as it is removed. This can be particularly helpful if a transit-damage claim needs to be investigated.

Please keep the packaging until you are satisfied that everything has arrived safely.

If an item arrives damaged, broken, incorrect or with something missing, please contact us as soon as reasonably possible, within 24 to 48 hours of delivery.

Please send photographs of the outer package, shipping label, internal packaging and the product or damage. Please do not discard the product or packaging until we have reviewed the issue.

After assessing the claim, Homa Atelier may offer an appropriate solution such as repair, replacement, replacement parts, store credit or refund, depending on the circumstances and availability.

We want you to be happy with your Homa Atelier purchase. If you need to request a return or refund, please email us within 48 hours of delivery, quoting your order details and explaining the reason for your request. For damaged or incorrect items, please include clear photographs of the product and packaging to help us resolve the matter quickly.

Requests received after 48 hours will not be eligible for a return or refund, except where otherwise required by applicable law.

Since many Homa Atelier pieces are handmade, fragile, one-of-a-kind, vintage, repurposed or made specifically to order, we do not offer unconditional returns or exchanges on every product.

Eligible returns will generally be considered where the item is materially different from what was ordered, has arrived damaged in transit, has a missing item or component, or has a product defect attributable to Homa Atelier.

A return requested simply because you changed your mind, selected the wrong size, prefer a different colour, or find that the item does not suit your space will not be accepted.

Customised, personalised, made-to-order, specially sourced, vintage, repurposed and one-of-a-kind pieces may be non-returnable, except where required by applicable law.

Where a refund is approved, it will normally be processed to the original payment method or another mutually agreed method. The time taken to appear in your account may depend on the bank, card issuer or payment provider.

Where a return is due to an error or defect attributable to Homa Atelier, we will generally bear the reasonable return shipping cost. In other approved return situations, return freight may be the Customer’s responsibility.

Please use the bulb type, wattage, voltage, plug, adapter and electrical components specified for the product. Unless specifically stated otherwise, bulbs are not included.

Hard-wired or ceiling-mounted lighting should be installed by a suitably qualified electrician.

Homa Atelier cannot accept responsibility for damage or injury resulting from incorrect installation, incompatible electrical components, unauthorised modifications or repairs, voltage fluctuations, misuse or use contrary to supplied instructions.

Natural materials age beautifully, but they require care. Terracotta, wood, silk, jute, bamboo, water hyacinth and similar materials can respond to moisture, humidity, heat, sunlight and temperature changes. Over time, natural changes in colour, texture, patina or shape may occur.

Unless otherwise specified, avoid prolonged exposure to water, excessive humidity, harsh direct sunlight and strong cleaning chemicals. Follow any product-specific care instructions supplied with your purchase.

Some pieces are made from objects and materials that have lived a previous life. Small scratches, dents, marks, repairs or variations in colour and patina may therefore be present. These are part of the history and character of reclaimed, vintage and repurposed pieces and are not necessarily defects. Where an item has been restored, altered or modified by Homa Atelier, we will describe this as clearly as reasonably possible in the product information.

For unusually large, heavy, fragile or awkward-to-ship pieces, additional packaging, handling, insurance or freight charges may apply. Where specialist transport is required, we will discuss arrangements and charges before dispatch. Difficult-access deliveries may also attract additional charges.

We want you to feel confident about your purchase. If you have questions about dimensions, materials, care, suitability or delivery, please contact us before ordering.

For any issue after delivery, please contact us promptly with your order details and photographs where relevant. We will always try to resolve genuine issues fairly and reasonably.

Severe weather, natural disasters, transport disruption, strikes, government restrictions, supply interruptions and other events beyond our reasonable control may affect production or delivery. Where this happens, we will do our best to keep you informed and find a practical solution.

Nothing in this policy is intended to take away or limit any consumer rights or remedies that cannot legally be excluded under applicable Indian law. If you have a concern, we encourage you to contact Homa Atelier first so that we can try to resolve it promptly and amicably.

We may update this policy as Homa Atelier grows and our products, delivery arrangements and sales channels evolve. The policy applicable to your order will generally be the version in force when your order is accepted, subject to applicable law.

Homa Atelier respects the privacy of its Customers and is committed to handling personal data responsibly and in accordance with applicable laws of India, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules and regulations made thereunder, as applicable from time to time.

In the course of providing its products and services, Homa Atelier may collect and process personal information such as the Customer’s name, contact details, billing and delivery address, telephone number, email address, payment-related information, order details and other information reasonably necessary to process and fulfil an order, provide customer support, communicate with the Customer, prevent fraud or misuse, and comply with applicable legal obligations.

Homa Atelier will process personal data only for specified, lawful purposes and will seek to limit the personal data collected to what is reasonably necessary for those purposes.

Where consent is required under applicable law, Homa Atelier will seek the Customer’s consent in a clear and informed manner and will provide appropriate information regarding the personal data being collected and the purpose for which it is being processed.

Where processing is based on consent, the Customer may withdraw such consent, subject to applicable law and any consequences that may necessarily follow from such withdrawal. Withdrawal of consent will not affect the lawfulness of processing carried out before such withdrawal.

Homa Atelier may share or disclose personal data with service providers and other parties where reasonably necessary to operate its business and provide its products and services. This may include payment service providers, logistics and delivery partners, technology and hosting service providers, customer-support providers, professional advisers and other service providers engaged by Homa Atelier.

Homa Atelier will seek to ensure that such parties process personal data only for authorised purposes and take appropriate measures to protect such information.

Homa Atelier may also disclose personal data where required or permitted by applicable law, regulation, court order or lawful governmental authority.

Homa Atelier will take reasonable technical and organisational measures appropriate to the nature of the personal data processed to protect personal data against unauthorised access, disclosure, alteration, loss, misuse or destruction.

However, no method of transmission or electronic storage can be guaranteed to be completely secure, and Homa Atelier cannot guarantee absolute security of personal data.

Homa Atelier will retain personal data only for as long as reasonably necessary to fulfil the purposes for which it was collected, provide services to the Customer, maintain appropriate business and transaction records, resolve disputes, prevent fraud or misuse, or comply with applicable legal and regulatory requirements.

When personal data is no longer required for a lawful purpose, Homa Atelier will take reasonable steps to delete, erase or otherwise dispose of such data in accordance with applicable law and its internal data-retention practices.

Subject to applicable law, a Customer may have rights in relation to their personal data, including the right to obtain information regarding the processing of their personal data, request correction or updating of inaccurate or incomplete personal data, request deletion or erasure of personal data where applicable, withdraw consent where processing is based on consent, and raise a grievance concerning the processing of their personal data.

A Customer wishing to exercise any applicable right or raise a privacy-related grievance may contact Homa Atelier using the contact details provided in this Terms & Conditions document or in Homa Atelier’s Privacy Policy.

Homa Atelier will address such requests and grievances in accordance with applicable law.

Further information regarding the categories of personal data collected by Homa Atelier, the purposes and manner of processing, data retention, sharing with third parties, security practices and the rights and procedures available to Customers is provided in Homa Atelier’s Privacy Policy, which forms part of Homa Atelier’s overall privacy framework.

Homa Atelier may update its privacy practices, Terms & Conditions or Privacy Policy from time to time to reflect changes in its business practices, technology or applicable laws and regulations. Any material changes will be communicated or made available to Customers in accordance with applicable law.

Nothing in this section limits any right or protection available to a Customer under applicable Indian law. In the event of any inconsistency between this section and a mandatory requirement of applicable data-protection law, the applicable law shall prevail.

Homa Atelier’s website may use cookies and similar technologies to help the website function properly, provide a better browsing and shopping experience, remember certain preferences, understand how visitors use the website and, where applicable, support marketing and advertising activities.
